Terms and Conditions of Use — Elfello

These terms govern the use of the “Elfello” mobile application for iOS and Android (identifier com.opharana.elfello) and of the page of this website that lets you join a group from your browser (hereinafter, together, “Elfello”), owned by OPHARANA LLC, with its registered address at 99 Wall Street, Suite 1432, 10005, New York, United States, and email address hello@opharana.com.

By downloading, installing or using Elfello, you accept these terms. If you do not agree with them, do not use it.

The essentials

  • Elfello is free, with ads.
  • Elfello Plus is optional: a monthly subscription that renews automatically until you cancel it, or a one-time lifetime purchase.
  • Purchases are charged and refunded by Apple or Google, not by us.
  • No passwords: your account is anonymous and tied to your phone or your browser. To create a group or join one, we ask for your name and email address.
  • Minimum age: 14.

1. What Elfello is

Elfello is a tool for organizing Secret Santa exchanges: creating a group with its date and budget, inviting other people with a link, joining from the app or from the browser, marking who cannot draw whom and holding a secret draw. The draw takes place on our server, at random among the combinations that respect the exclusions set.

Elfello does not sell, buy or deliver gifts and does not handle money between participants. The budget is only a guideline, and each group arranges the gift exchange on its own.

2. Minimum age

Elfello is intended for people aged 14 and over. By using it, you represent that you are at least that age.

3. Your anonymous account and your email address

Elfello does not require sign-up or a password. When you open the app, or a group's link in your browser, an anonymous account is created and tied to that installation or that browser. To create a group or join one, we ask for your name and email address, which we use to let you know what is happening in your group; nobody in the group sees your email address. We will only send you news from Elfello and other OPHARANA LLC apps if you tick the box to receive it, and you can unsubscribe whenever you want.

If you delete the app or your browser data, or switch phones, you lose access to your groups and we cannot restore it, because your account has no password to sign back in with. You can delete your data at any time from Settings → “Delete my data” (details in the Privacy Policy).

4. Groups, content and conduct

You are responsible for what you write in Elfello: the names of your groups, your name in each group and the email address you give us. That email address must be yours: do not enter someone else's email address without their permission. By using Elfello, you agree not to:

The organizer of a group decides whom to invite, whom to remove before the draw and which exclusions to set. Share the link only with the people in the group: anyone who has it can see the group's name, its date and its budget and, as long as the draw has not taken place, join it. We may delete content and groups that breach these terms.

5. Elfello Plus

Elfello Plus removes the ads from the app and lets you organize unlimited groups (without Plus, you can organize up to 2 groups at a time and join as many as you want). It is offered in two forms, with the price in your currency shown before you buy:

How to cancel the subscription:

If you cancel, you keep Plus until the end of the period you have already paid for and you will not be charged again. Uninstalling the app or deleting your data does not cancel the subscription.

6. Free months of Plus for inviting others

When someone new to Elfello joins a group you organize and later organizes their own group with at least 3 people and draws names, you both get a month of Elfello Plus. Each invited person earns a reward only once, and each account can earn a maximum of 12 months by inviting others. The months are added to any you already have and are verified on our server.

Free months have no monetary value, cannot be exchanged for cash or transferred, and do not affect a paid subscription, which keeps renewing until you cancel it. We may change or end this promotion at any time, without affecting months already earned, and cancel rewards obtained fraudulently. We never reward store ratings or social media posts.

7. Advertising

The app shows ads from Google AdMob and in-house ads from TuIAgencia, the owner's agency. In the European Economic Area, the United Kingdom and Switzerland, you are asked for consent before any Google ad is loaded. While Elfello Plus is active, no advertising is shown. 8. Service availability

Elfello depends on third-party servers and services and requires an internet connection. We do not guarantee that it will work without interruptions or errors. We may modify, update or remove features and, if it comes to that, discontinue Elfello; in the event of a permanent shutdown, we would announce it with reasonable notice in the app or on this website.

9. Intellectual property and license

Elfello, its code, its texts, its design and its graphic elements are owned by OPHARANA LLC or by third parties that have authorized their use. We grant you a personal, limited, non-exclusive, revocable and non-transferable license to use Elfello for private, non-commercial purposes. You may not copy, distribute or modify it, or create derivative works from it.

The app's name is set in the Mountains of Christmas typeface, by Tart Workshop, licensed under Apache 2.0. The app also includes third-party software under its respective open source licenses.

10. Limitation of liability

Elfello is provided “as is”. To the fullest extent permitted by applicable law, the owner is not liable for indirect damages, loss of profits, loss of data or any harm arising from the unavailability of the service, from errors in the app, from the use you make of it or from what other users write. Nor is the owner liable for the gifts or the exchanges between participants, which are arranged outside Elfello.

Nothing in these terms excludes or limits any liability that cannot lawfully be excluded, such as liability arising from willful misconduct, or the rights that consumer law grants to users acting as consumers.

11. Relationship with Apple and Google

These terms are entered into between you and OPHARANA LLC, not with Apple or Google. Apple and Google are not parties to the service and assume no responsibility whatsoever for the app, its content, its maintenance or its support. In the case of iOS, Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

12. Changes to these terms

We may update these terms to reflect changes in Elfello or in the applicable law. The version in force will always be the one published on this page, with its update date. If the change is material, we will notify you inside the app. Continuing to use Elfello after publication constitutes acceptance.

13. Governing law, jurisdiction and language

These terms are governed by Spanish law. For the resolution of any dispute, and where the applicable consumer law so permits, the parties submit to the courts and tribunals that have jurisdiction under the law. If you are acting as a consumer, you retain the right to bring proceedings before the courts of your place of residence. These terms are published in several languages; in the event of any discrepancy, the Spanish version prevails.
